HOW THE MEDICAL DISABILITY PROCESS WORKS

If you have been injured during your military service, there is a complex system known as the Integrated Disability Evaulation System (IDES) which will evaluate your medical conditions, decide if you remain fit for duty, decide what your medical retirement/separation award AND your VA disability rating will be.

Starting with a Medical Evaluation Board,  the IDES will evaluate the Service member’s:

  • Medical history
  • Current condition
  • Extent of an injury or illness

Taking these factors into consideration, the MEB will determine whether or not the Service member’s condition will interfere with his or her ability to carry out duties at full capacity. However, the MEB does not have the authority to make a decision about a Service member's benefits. Your case goes through a second stage known as the Physical Evaulation Board (PEB). The PEB decides what, if any, benefits you should receive as a result of your injuries or medical conditions.

The IDES process requires both written responses and advocacy at hearings throughout multiple levels of the process.

The Owens Law Firm works with a medical consultant in order to fully understand what your condition is and what all of the evidence means. As legal professionals, we dont pretend to be doctors, we use a medical expert to fill in the complete medical picture and provide you with the most knowledgeable advice throughout the process.

The IDES process is both medical and legal - ensure you are properly represented throughout every stage of the process.
